By booking or using any services provided by Hot Springs Mobile Kayak Rentals, you agree to the following Terms & Conditions.

1. Services Provided

Hot Springs Mobile Kayak Rentals offers:

  • Kayak rentals (pickup at our shop location)

  • Mobile kayak delivery services

  • Guided kayak tours on the Ouachita River and Lake Hamilton

All services are subject to availability and weather conditions.

2. Eligibility & Age Requirements

  • Renters must be at least 18 years old to make a reservation

  • Minors must be accompanied by a parent or legal guardian

  • All participants must be physically capable of safely operating a kayak

We reserve the right to refuse service to anyone for safety reasons.

3. Assumption of Risk & Liability Waiver

Kayaking is an outdoor recreational activity that involves inherent risks, including but not limited to:

  • Drowning

  • Injury from water conditions, wildlife, or obstacles

  • Weather-related hazards

By using our services, you acknowledge and accept these risks.

Hot Springs Mobile Kayak Rentals is not liable for:

  • Personal injury or death

  • Loss or damage to personal property

  • Accidents occurring during rental or tour use

All participants may be required to sign a separate liability waiver prior to participation.

4. Equipment Responsibility

Customers are responsible for all rented equipment during the rental period.

You agree to:

  • Return all equipment in the same condition it was received (normal wear excepted)

  • Pay for any lost, stolen, or damaged equipment

  • Use equipment only as intended and in a safe manner

5. Reservation & Payment Terms

  • Full payment is required at the time of booking through our website

  • Reservations are not confirmed until payment is received

  • All bookings are subject to our Refund Policy

6. Cancellations & Refunds

Please refer to our Refund Policy for complete details.

In summary:

  • No refunds for customer cancellations, no-shows, or late arrivals

  • Refunds are only issued if we are unable to fulfill your reservation

7. Weather Conditions

We reserve the right to delay, reschedule, or cancel any rental or tour due to unsafe weather or water conditions.

Safety decisions are made at our sole discretion.

8. Delivery Services

For kayak delivery:

  • Customers must provide accurate delivery details at booking

  • Someone must be present to receive the equipment at the agreed time

  • Failure to be present may result in cancellation without refund

9. Prohibited Use

The following are strictly prohibited:

  • Operating kayaks under the influence of drugs or alcohol

  • Reckless or unsafe behavior

  • Use of equipment outside designated or agreed-upon areas

Violation of these terms may result in immediate termination of your rental without refund.

10. Limitation of Liability

To the fullest extent permitted by law, Hot Springs Mobile Kayak Rentals shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.

11. Changes to Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of our services constitutes acceptance of any changes.
